Based on normal Industry Standards, this is a plain English and common sense summary of my terms and conditions. Do have a browse It’s not frightening.

Price Guide
Due to the varied nature of my work, the price for each job is arrived at after consultation with client.
I normally grant a one year exclusive license to reproduce the commissioned work in a specific form, for a specific use within a given territory.
Copyright is not usually assigned. However if the client ‘insists’, the basic price for the job is multiplied by a factor of 4.
The cost of delivery/ courier of artwork is charged to the client.
Most working expenses will have been costed into the commission fees, unless specifically stated in my quotation.

Terms and conditions
A written purchase order is required before any works can commence.
First time clients must pay a deposit of 50%.

Once an order is placed, a 25% deposit is payable to book time into my schedule.
I shall keep to all arranged deadlines if the client keeps to its deadlines.
If there are any delays in briefing the work, supplying of reference material or approval of roughs, I cannot guarantee keeping to the initial deadline and will not be held responsible for any losses incurred.

Ownership of Copyright
I remain the owner of the copyright for all my work.
I am free to sell further rights for use of my work unless otherwise agreed.
If the client takes up additional rights, permission has to be obtained and a fee will be agreed at that time.
If the client wishes to purchase the original artwork, the sale of further rights by the artist is not affected.

Ownership of Artwork
All artwork remains my property. There maybe a random act of kindness on my part and I may sell an original, this will only occur by negotiation.
I reserve the right to use my artwork for ‘self promotion’ at any time.

Cancellation Fees
If you commission an Illustration from me and then change your mind and cancel, ‘cancellation fees apply’ If your reason for cancellation is that the work is not what you had expected, the ‘rejection fees’ section apply.

The cancellations fees are:
25% of the agreed fee, if you cancel before I send you the roughs.
33% if you cancel once you have seen the roughs.
100% if you cancel when I send you the completed illustration.
Pro rata for anything in between.

Rejection Fees
I will do my utmost to establish what you are looking for in order to get a very clear brief from you and you will always get to comment on roughs.
If there is an unfortunate case where a client doesn’t want to pay because ‘they feel the work isn’t in accordance with the brief,’ while I beg to differ. To avoid a lot of ‘hot air’ about who is right; the agreement shall be to ‘split it down the middle.’

The rejection fees are:
50% of the agreed fee if you reject upon delivery of the completed work
25% if you reject on completion of roughs.
If the ‘roughs‘ rejection fee has been paid, the client has no right to use any part of the work.
The roughs /original remain my property.

Alterations
I assert my moral right of paternity and integrity, therefore a client does not have the right to alter the artwork unless agreed with me first. ( It’s worth a simple phone call, just to clarify things. I realise that work requires tweaking etc..and it’s generally ‘no big deal.’)

File Copies
It would be appreciated if the client would supply some proofs, a scan or printed material.
‘It’s nice to show off.’

Payment
Final payment shall be within 30 days from the date of my invoice.
